Terms of Service

1. Acceptance of Terms
By accessing or using Meshcast (the "Service"), you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
Streaming platform. Meshcast provides live video streaming infrastructure including RTMP/SRT/WebRTC ingest, multi-destination restreaming, cloud transcoding, and video-on-demand recording storage.
Server-based architecture. Unlike peer-to-peer services, your streams pass through our media servers. We do not monitor stream content but retain operational logs for service operation and legal compliance.
Third-party infrastructure. The Service uses Cloudflare (DDoS protection, CDN), Vultr/AWS (server hosting), Backblaze B2 (recording storage), and Stripe (payments). Their respective terms and privacy policies apply to their services.
No emergency services. The Service does not provide access to emergency services.
3. Accounts and Eligibility
Age requirement. The Service is intended for individuals 16 years of age or older. If you are under 16, do not use the Service.
Account security. You authenticate via Google OAuth. You are responsible for maintaining the security of your Google account and any stream keys or credentials we provide.
Anonymous streaming. Limited anonymous streaming may be available without an account, subject to reduced features and quotas.
4. Subscription and Payment
Free and paid tiers. The Service offers free and paid subscription tiers with different feature limits. Current pricing is displayed at /pricing.
Billing. Paid subscriptions are billed monthly via Stripe. You authorize us to charge your payment method on a recurring basis until you cancel.
Cancellation. You may cancel your subscription at any time through the billing portal. Access continues until the end of your current billing period. No refunds for partial months.
Price changes. We may change prices with 30 days' notice. Continued use after a price change constitutes acceptance.
5. Your Content
You retain ownership of content you stream or upload. By using the Service, you grant us a limited license to process, transcode, store (for recordings), and transmit your content solely to provide the Service.
You are solely responsible for your content and for having all necessary rights and consents to stream it. You represent that your content does not violate any third-party rights or applicable laws.
6. Prohibited Conduct
You may not use the Service to:
- Engage in or facilitate child sexual exploitation, grooming, or any content sexualizing minors
- Stream illegal content, including but not limited to CSAM, revenge pornography, or content violating applicable laws
- Harass, threaten, defame, dox, or incite violence against any person
- Infringe intellectual property, privacy, or publicity rights of others
- Commit fraud, phishing, distribute malware, or engage in deceptive practices
- Stream content you do not have rights to broadcast (e.g., unauthorized sports, movies, TV)
- Attack, overload, reverse-engineer, or attempt to bypass security measures of the Service
- Resell or sublicense access to the Service without authorization
- Use the Service for any purpose that violates applicable law
7. Content Moderation and Reporting
No proactive monitoring. We do not actively monitor stream content.
Reporting. To report abuse, contact steve@seguin.email with stream key, timestamps, and description. Do not send illegal media.
Enforcement. We may suspend or terminate accounts, disable stream keys, or restrict access based on reports, legal requirements, or Terms violations. We may preserve logs and cooperate with law enforcement as required by law.
Child safety. For suspected child exploitation, report to your national hotline (e.g., NCMEC CyberTipline, Cybertip.ca) and share the report number with us.
8. Recordings and Storage
Recording feature. Paid tiers may include stream recording. Recordings are stored on Backblaze B2 and subject to tier-specific retention limits.
Your responsibility. You are responsible for downloading recordings you wish to keep before they expire. We are not liable for recordings deleted due to expiration, account termination, or technical issues.
Deletion. Upon account termination or recording expiration, we will delete your recordings within 30 days.
9. Intellectual Property
The Service (software, brand, site content, documentation) is owned by us or our licensors and protected by intellectual property laws. Open-source components are provided under their respective licenses.
You may not use our trademarks, logos, or branding without written permission.
10. Third-Party Services
The Service may integrate with third-party platforms (YouTube, Twitch, Discord, VDO.Ninja, etc.). Their terms and privacy policies govern your use of those services. We are not responsible for third-party services.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." We make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, security, or error-free operation.
Stream quality depends on your network, encoder settings, viewer connections, and factors outside our control. We do not guarantee uptime, latency, or viewer capacity.
We may modify, suspend, or discontinue the Service (or any features) at any time without liability.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
IN ANY CASE, OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
Some jurisdictions do not allow certain liability limitations. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless the Service provider and our affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of any third-party rights.
14. Termination
By you. You may stop using the Service and cancel your subscription at any time.
By us. We may suspend or terminate your access immediately for Terms violations, illegal activity, non-payment, or at our discretion with reasonable notice.
Effect. Upon termination, your right to use the Service ends. Sections 5, 11-13, and 15-17 survive termination.
15. Changes to Terms
We may modify these Terms from time to time. For material changes, we will update the effective date and post a notice on the site. Continued use after the new effective date constitutes acceptance.
16. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules.
You agree to the exclusive jurisdiction and venue of the courts located in Toronto, Ontario, for any dispute not subject to a different mandatory forum.
Informal resolution. Before filing any claim, you agree to attempt informal resolution by contacting us at steve@seguin.email.
17. General
Severability. If any provision is found unenforceable, the remaining provisions remain in full force.
No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
